1. Introduction
Welcome to PlayTheMove. By accessing and using our platform, you agree to comply with these terms. If you do not agree with these terms, please refrain from using our platform.
2. Account Registration
To become a creator, you must register for an account. You must provide accurate and complete information during registration and keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account information, including your password.
3. User Conduct
You must not post illegal or prohibited content, including hate speech, harassment, or explicit material. Respectful interaction is expected at all times. Prohibited behaviors include:
• Distributing unsolicited promotional or commercial content.
• Manipulating metrics such as views, likes, or subscribers.
• Misusing reporting, flagging, complaint, or dispute processes.
• Running non-compliant contests.
4. Privacy Policy
We collect, use, and protect your data in accordance with our Privacy Policy, which complies with GDPR and the California Consumer Privacy Act (CCPA). You must agree to this policy upon registration. [Link to Privacy Policy]
5. Content and Usage
Creators can post premium content, live streams, and private messages. You retain ownership of your content, but grant PlayTheMove a license to use, display, and promote it on our platform. You are responsible for the content you upload and must ensure it does not violate any intellectual property rights or applicable laws.
6. Earnings and Payments
Creators can earn money through various means. Payments can be requested once a minimum threshold of $50 is reached and will be transferred within 3 business days. Payments can be made in USD, CAD, EUR, and GBP, among other currencies.
7. User Rights
Users have the right to access, correct, or delete their data in accordance with GDPR and CCPA regulations. Users can manage their data as described in our Privacy Policy.
8. Liability Limitations
PlayTheMove is not liable for user actions or content. We provide the platform “as is” and disclaim any warranties. We are not responsible for any damages arising from the use of our platform.
9. Dispute Resolution
Any disputes will be resolved through arbitration under the laws of Ontario, Canada. Users agree to waive class action rights and agree that disputes must be resolved in Toronto courts.
10. Changes to Terms
We may modify these terms at any time. Notice of changes will be provided, and continued use of the platform constitutes acceptance of the new terms.
11. Termination of Service
We reserve the right to terminate or suspend accounts that violate these terms. Users may terminate their accounts at any time.
12. Payment Terms
Payments are subject to processing fees and must meet a minimum threshold. Refund policies are outlined in our Payment Policy.
13. Age Restrictions
To use PlayTheMove, you must be at least 18 years old. By registering, you confirm that you meet this age requirement. If you are under 18, you are not permitted to create an account or access content on PlayTheMove. This restriction is in place to ensure compliance with applicable legal requirements and to protect our users.
14. Users’s Role and Content Review
We may review pages and posts to enforce these terms and our policies, including investigating potential violations.
15. Account Deletion and Termination
You can delete your account at any time. We can terminate or suspend accounts at our sole discretion and remove any content that violates our terms.
16. User Creations and Licenses
Creators retain ownership of their creations but grant PlayTheMove a broad license to use, copy, and distribute their content as part of our services.
17. Third-Party Apps and Services
You may grant third-party apps access to your PlayTheMove account. You may also revoke this access at any time.
18. Indemnity
You will indemnify us from all losses and liabilities, including legal fees, arising from your use of PlayTheMove.
19. Warranty Disclaimer and Limitation of Liability
PlayTheMove is provided “as is” without warranty of any kind. Our liability is limited to the amount of money we have earned through your use of PlayTheMove.
20. Points System
Users can gain and purchase points on PlayTheMove. These points can be used for various features and services on the platform. The purchase and use of points are subject to our Payment Policy and are non-refundable.
21. Advertisements and Commercial Content
You grant us permission to use your name, profile picture, content, and information in connection with commercial, sponsored, or related content served by us. We do not give your content or information to advertisers without your consent.
22. Compliance with Laws
You agree to comply with all applicable laws, including those related to copyright and data privacy.
23. Content Removals
We provide more information about what happens when content that violates our terms or policies is removed.
24. Your Intellectual Property Rights
When you share your own content, you continue to own the intellectual property rights in that content. You grant us permission to display that content, and this permission ends when the content is deleted from PlayTheMove.
25. What Happens When You Delete Content
When you delete content you’ve posted, it is no longer visible but can take up to 90 days to be removed from our systems.
26. Modifications and Amendments
We will provide notice of changes to these terms and offer an opportunity to comment on them before they take effect. Your continued use of PlayTheMove constitutes acceptance of the amended terms.
27. Special Provisions for Advertisers and Pages
Additional terms apply to users who create pages or advertise on the platform.
28. Seller Policies
Sellers are responsible for their own policies regarding refunds, exchanges, and returns. Individual policies may vary, and sellers must fulfill agreements made with buyers, including issuing refunds or providing proof of shipping for replacements.
29. European Union Compliance
Sellers must comply with the EU Directive on Consumer Rights when dealing with EU buyers. Disputes with EU buyers can be resolved using the EU Online Dispute Resolution platform.
30. Fulfillment Services
If you use our fulfillment services, you must register each product and provide accurate descriptions, including weight and dimensions. PlayTheMove is not liable for any discrepancies. Fulfillment services are brokered by third-party warehouses and shipping services.
31. Shipping Responsibilities
You are responsible for compliance with all shipping regulations and for any local customs charges, import taxes, or duties related to your shipments. PlayTheMove provides access to shipping services on an “as is” basis and disclaims all warranties related to these services.
32. Chargebacks
PlayTheMove may contest chargebacks on your behalf, but assumes no liability for these efforts. You must provide all necessary information and authorizations to resolve chargeback disputes.
33. Uploading Content
You may upload content such as text, videos, and images. You must have the necessary rights to the content you upload and must not violate any intellectual property rights. Content must comply with our Community Guidelines and applicable laws.
34. Licenses Granted to PlayTheMove
By uploading content, you grant PlayTheMove a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the service and PlayTheMove’s business.
35. Licenses Granted to Other Users
You grant other users a worldwide, non-exclusive, royalty-free license to access your content through PlayTheMove and to use, reproduce, distribute, display, and perform it as permitted through the platform.
36. Content Removal by PlayTheMove
PlayTheMove reserves the right to remove content that violates these terms or our Community Guidelines. You will be notified of the removal and the reasons unless doing so would violate the law or risk legal liability.
37. Community Guidelines Strikes
PlayTheMove operates a system of “strikes” for content that violates our Community Guidelines. Repeated violations may result in account termination.
38. Digital Millennium Copyright Act (DMCA)
If you believe your copyright has been infringed, you can submit a notification pursuant to the DMCA. Details on how to submit such a notification are available on our platform.
39. Age-Restricting Content
Content that may not be suitable for viewers under 18 may be age-restricted. Such content will not be visible to users under 18, logged-out users, or those with restricted mode enabled.
